pollDisciplinary proceedings began today against Joe Groia, who was accused of incivility in his defence of Bre-X geologist John Felderhof.

In an op-ed in today’s Globe, Edward Greenspan and L. David Roebuck argue that Groia’s tactics, while “not always moderate or respectful,” were not criticized by the trial judge — who “was in the best position to censure the alleged misconduct but declined to do so.” The hearing, they argue, is a case of the Law Society “selectively prosecuting defence counsel for alleged misconduct in the face of the court, but not prosecutors.”
